OMG!!!!!! More scum rises to the surface of the pond! What a jerk! If they did this it is just despicable. I know many of us were terribly worried about Thorn SOng after we watched him bolt the way he did. I never heard anything about abscesses in his feet until now (at least that I can remember). We were worried that he was a nut case but if he had terrible abscesses in BOTH front feet during that race that would explain WHY he bolted...his feet were hurting him! OMG! This makes me angry! How the Hell they could even think about running him with those apparently bad abscesses...how could they have not noticed he was that sore and those abscesses were that bad if they claim that immediately after the race they discovered them and sent him to the vet. ARGH!!!!!!!!!!!!!!!!!!!!!!!!!!! I KNEW this story would have a fishy twist to it...I just KNEW it![url=http://www.sweetim.com/s.asp?im=gen&lpver=3&ref=12]  [/url]

"I know the horse hasn't been put down," Mike Mitchell, Thorn Song's California trainer, said Tuesday. "I just checked with my vet and he said he has not been put down and he has a chance of standing as a stallion." Thorn Song was taken to a veterinary clinic with severe abscesses in both front feet after bolting in a race July 25 at Del Mar, his first race for Mitchell. Mitchell said he had not been involved with Thorn Song since the horse left Del Mar and could not speak to the circumstances of the insurance claim. According to records filed by Fifth Third Bank in Zayat's bankruptcy case in New Jersey, Zayat claimed a loss on Thorn Song on Aug. 2, 2009. The check from North American Specialty Insurance Company states that the payment covers "HORSE MORTALITY THORN SONG LIMIT LESS DED." In its filing, Fifth Third said the claim was made "under the mortality policy for Thorn Song" and that Zayat hid the payment rather than turn it over to the bank. Fifth Third also said Zayat has failed to name them as a loss payee on some policies on his horses, which are collateral for $34 million in loans. "After receiving information that a horse named 'Thorn Song' was injured in a race, Fifth Third made multiple inquiries of the Defendants as to the whereabouts and well-being of Thorn Song, and whether that animal is an insurance loss," according to the filing. "Zayat Stables failed to respond to any of those inquiries." Attorneys for Zayat did not return calls for comment. An attorney for Fifth Third said the bank would have no comment. The bank, which has sued Zayat in U.S. District Court in Lexington alleging he has defaulted on his loans, said it plans to ask for a trustee in the bankruptcy to take over Zayat's 200-plus racehorse stable.

if he collected the insurance, he could never say who the horse was if he sttod at stud, and you'd never be able to register a foal, in all honesty if you're going to scam the bank and insurance company you'd be better off to kill the horse than try to hide him. And he must have had to furnish some pretty convincing proof to the insurance co. to collect 2.75 million....

I was so upset last night when I first read that the insurance company paid out on Thorn Song, but now knowing what Mitchell has said, there is hope that TS is still alive. It is possible that the insurance company paid Zayat and took over care and ownership of the horse in hopes that he could be sold later for stud. I'm really hoping this is the case cause I really like him and would be equally happy to know he is away from Zayat for good.

but if the insurance company took him over,then why the questions? Wouldn't the insurance company just tell the bank hey, yo, we own this horse?

Zayat is definitelly guilty of conceiling the pay-off from the insurance company and obviously not telling the bank where Thorn Song was/is. It's possible the insurance company did not know anything about his problems with the bank and if what they state is true and he did not add them as loss payee, then they would have no reason to ever contact the bank when they paid the claim. I think it's safe to say this is going to get very ugly, and fast, especially if Thorn Song is in fact still alive(which I pray he is).
